By accessing or using TrackStack ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

TrackStack is operated by Servers Connect LLC ("Company", "we", "us", or "our"). These Terms govern your access to and use of our website, API, and MCP server software.

2. Description of Service

TrackStack provides up-to-date framework intelligence to AI assistants through:

• An MCP (Model Context Protocol) server that runs locally on your machine
• A cloud-based API that provides framework best practices and intelligence
• A web dashboard for managing API keys, usage, and project intelligence
• Framework-specific recommendations, anti-pattern detection, and migration guides

3. Account Registration

To use TrackStack, you must:

• Create an account by providing accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental/guardian consent
• Notify us immediately of any unauthorized account access
• Be responsible for all activities that occur under your account

4. API Keys and Security

API keys are your responsibility:

• You must keep your API keys confidential and secure
• Do not share API keys or embed them in public repositories
• You are responsible for all usage associated with your API keys
• We reserve the right to revoke compromised API keys without notice
• Regenerate keys immediately if you suspect unauthorized access

5. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Scrape, data mine, or reverse engineer our intelligence data
• Resell, redistribute, or create derivative works from our API responses
• Exceed rate limits or attempt to circumvent usage restrictions
• Use the Service to develop competing framework intelligence products
• Transmit malware, spam, or any harmful code
• Violate any applicable laws or regulations

Workspace Tier ($89/month, includes 3 seats)

• Team workspace and shared views
• Instant sync (no cooldown)

Premium Tier ($199/month, includes 5 seats)

• Everything in Workspace
• Monorepo support
• Priority support
• $20 per additional seat per month

Payment Terms

• All fees are in USD and exclude applicable taxes
• Subscriptions auto-renew unless canceled
• 30-day money-back guarantee on all paid plans
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension

7. Referral Program

TrackStack offers a referral program that rewards users for inviting others to the platform. The program may be paused or unavailable at times. Participation is subject to the following terms:

Referral Rewards by Tier

• Free/Workspace Users: When your referral syncs their first project, both you and the referee receive 30 days of Workspace access. Maximum 3 months total (90 days) can be accumulated.
• Premium Users: When your referral becomes a paying customer, you receive 30 days of Premium access. Maximum 3 months total (90 days) can be accumulated.
• Workspace Users: When your referral becomes a paying customer, you receive 30 days of Premium access. Maximum 3 months total (90 days) can be accumulated.

Eligibility Requirements

• Referees must have a GitHub account at least 30 days old
• Each GitHub account can only be used for one referral reward
• Self-referral is prohibited
• Referrer and referee must be different individuals with separate accounts

Program Rules

• We reserve the right to deny rewards for suspected abuse, fraud, or gaming
• Creating fake accounts to claim referral rewards is a violation of these Terms
• Referral rewards have no cash value and cannot be transferred
• We may modify or discontinue the referral program with 30 days notice
• Violation of referral program rules may result in account suspension

8. Intellectual Property

Our IP

We retain all rights to:

• The TrackStack platform, API, and MCP server software
• Our framework intelligence database and curation methods
• All trademarks, logos, and branding
• Documentation, guides, and educational content

Your IP

You retain all rights to your code and projects. We only collect framework query patterns to improve our intelligence (see Privacy Policy). Your actual source code never leaves your machine.

9. Data Collection and Privacy

We collect and process data as described in our Privacy Policy, including:

• Account information (email, name)
• API usage patterns and request counts
• Framework query types (not your actual code)
• Billing information (processed by Stripe)

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Temporarily suspend service for updates or security patches
• Modify or discontinue features with 30 days notice

We are not liable for service interruptions, but will provide advance notice when possible.

11. Termination

By You

You may cancel your account at any time from the dashboard. Paid subscriptions remain active until the end of the billing period.

By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Fail to pay outstanding fees
• Abuse the service or harm other users

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

• Your use of the Service
• Your violation of any law or third-party rights

15. Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maryland or in federal court in the District of Maryland.

16. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or dashboard notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
